1. Introduction

The Platform is an online marketplace designed to connect travellers interested in adventure, active, and alternative tourism experiences with independent tour organizers, guides, companies, and other experience providers (“Organizers”).

The purpose of the Platform is to provide an online environment where Organizers can publish information about their tours, trips, expeditions, and travel experiences, and where travellers can discover, request, and arrange participation in such experiences.

The Platform does not organize, operate, conduct, manage, or provide any tours, activities, excursions, transportation, accommodation, guiding services, or other travel services.

The Platform acts solely as an intermediary marketplace that facilitates communication and interaction between travellers and independent Organizers.

By accessing or using the Platform, you agree to these Terms of Service (“Terms”). If you do not agree with these Terms, you must not use the Platform.

2. Definitions

For the purposes of these Terms, the following definitions apply:

“Platform” means the website, software, databases, and related services operated under the name [Platform Name].

“Traveller” means any person who accesses the Platform, searches for experiences, submits booking requests, or communicates with Organizers.

“Organizer” means any individual, company, guide, business, or other entity that publishes information about tours or experiences on the Platform.

“Tour” or “Experience” means any travel-related activity, adventure program, expedition, excursion, trip, or other experience published by an Organizer.

“Booking Request” means a request submitted by a Traveller to participate in a Tour.

“Booking Confirmation” means confirmation of a Booking Request by an Organizer through the Platform.

“User Account” means a personal account created by a Traveller or Organizer for using the Platform.

3. Nature of the Platform

The Platform is an online marketplace and information platform.

The Platform provides technical tools that allow:

Organizers to publish information about their Tours;
Travellers to search and discover available experiences;
Travellers to submit requests to participate in Tours;
Organizers and Travellers to communicate regarding possible participation;
The Platform to facilitate certain marketplace functions, including booking requests, notifications, and payments where applicable.

The Platform does not:

organize or provide Tours;
act as a tour operator;
act as a travel agency;
employ guides, instructors, captains, drivers, or other service providers;
control the activities of Organizers;
guarantee the quality, safety, legality, availability, or suitability of any Tour;
participate in agreements between Travellers and Organizers.

4. Independent Organizers

All Tours published on the Platform are provided by independent third-party Organizers.

Each Organizer is solely responsible for:

the organization and execution of their Tours;
compliance with applicable laws and regulations;
obtaining required licenses, permits, certifications, and insurance;
the safety of participants;
the accuracy of information published on the Platform;
communication with Travellers;
fulfillment of obligations arising from bookings.

The Platform does not act as an agent, representative, employee, partner, or legal representative of any Organizer.

5. Verification of Organizers

The Platform aims to maintain a reliable marketplace and may conduct reasonable verification procedures regarding Organizers.

The Platform may request information and documents, including but not limited to:

business registration information;
identity verification information;
professional qualifications;
licenses or permits;
insurance information;
other information relevant to the Organizer’s activities.

Verification procedures are intended only to improve marketplace reliability.

Any verification status, badge, or indication displayed on the Platform does not constitute a guarantee, certification, recommendation, or insurance of the Organizer or their Tours.

6. Organizer Listings

Organizers may publish information about their Tours subject to these Terms.

Organizers must ensure that all information provided is:

accurate;
complete;
current;
not misleading;
lawful.

Organizers are responsible for all content they publish, including:

tour descriptions;
photographs and videos;
prices;
availability information;
routes and itineraries;
requirements for participation;
safety information;
cancellation conditions.

The Platform reserves the right to review, modify, restrict, suspend, or remove any listing that violates these Terms or the interests of the marketplace.

7. Traveller Accounts

Travellers may create accounts to use marketplace features.

Travellers are responsible for:

providing accurate information;
maintaining confidentiality of account credentials;
using the Platform lawfully;
providing truthful information when submitting Booking Requests.

8. Organizer Accounts

Organizers creating accounts agree that they:

have the legal right to provide information about their Tours;
will provide accurate information;
will respond to Booking Requests in a timely manner;
will communicate honestly and professionally with Travellers;
will comply with all applicable laws and regulations.

9. Booking Process

When a Traveller submits a Booking Request, the request is transmitted to the relevant Organizer.

The Organizer must review and confirm or reject the Booking Request through the Platform.

If an Organizer does not confirm a Booking Request within the period specified by the Platform, the Platform may automatically cancel the request.

If any advance payment or platform fee has been collected and cancellation occurs due to failure of the Organizer to confirm the Booking Request, the Platform may refund the applicable amount to the Traveller.

After an Organizer confirms a Booking Request:

the Organizer receives the Traveller’s relevant contact information;
the Traveller receives the Organizer’s contact information;
further communication and arrangements take place directly between the Traveller and Organizer.

10. Payments and Platform Fees

The Platform may introduce fees, commissions, or other charges for Organizers or Travellers.

At the initial stage of operation, registration and listing of Tours may be provided free of charge.

The Platform reserves the right to introduce or modify fees, commissions, or pricing structures at any time by publishing updated information on the Platform.

Changes to fees will not apply retroactively to already confirmed bookings unless otherwise required by law or agreed by the parties.

11. Reviews and Ratings

The Platform may provide a rating and review system designed to help users make informed decisions.

Reviews may only be submitted by Travellers who have participated in a booking process through the Platform.

The Platform may moderate, remove, or refuse publication of reviews that:

contain false information;
are abusive, threatening, or discriminatory;
violate applicable laws;
are unrelated to the relevant Tour;
appear to be fraudulent or manipulated.

The Platform does not guarantee that reviews represent complete or objective opinions of all users.

12. Prohibited Activities

Users must not:

provide false information;
impersonate another person or organization;
publish illegal content;
attempt to manipulate ratings or reviews;
use the Platform for fraudulent purposes;
interfere with Platform operation;
violate the rights of other users.

13. Suspension and Removal of Accounts

The Platform may suspend, restrict, or permanently remove accounts or listings if users:

violate these Terms;
provide misleading information;
receive repeated complaints;
fail to comply with marketplace standards;
create risks for other users or the Platform.

The Platform may apply measures including:

warnings;
reduced visibility in search results;
temporary suspension;
permanent removal.

14. Limitation of Responsibility

To the maximum extent permitted by applicable law, the Platform shall not be responsible for:

the quality of Tours;
the actions or omissions of Organizers;
injuries, losses, damages, or accidents occurring during Tours;
changes or cancellations made by Organizers;
weather conditions;
transportation issues;
visa or travel documentation requirements;
insurance coverage;
any agreement between Traveller and Organizer.

Travellers participate in Tours at their own discretion and should independently evaluate the suitability, risks, and requirements of any experience.

15. Disclaimer

The Platform provides information and marketplace functionality on an “as available” basis.

The Platform does not guarantee that:

all listings are accurate;
all Tours will be available;
all Organizers meet every legal requirement;
the Platform will operate without interruptions.

16. Intellectual Property

All Platform software, design, trademarks, logos, and original content belong to the Platform or its licensors.

Organizers retain ownership of content they upload but grant the Platform a non-exclusive right to display and promote such content for marketplace purposes.

17. Changes to These Terms

The Platform may update these Terms from time to time.

Updated Terms become effective when published on the Platform.

Users are responsible for reviewing the current version of these Terms.

18. Privacy and Data Protection

The processing of personal information is governed by the Platform’s Privacy Policy.

By using the Platform, users acknowledge that certain personal information may be shared between Travellers and Organizers when necessary to complete a Booking Request.

19. Force Majeure

The Platform shall not be responsible for failure or delay caused by circumstances beyond its reasonable control, including technical failures, natural disasters, government actions, internet disruptions, or other events beyond reasonable control.

20. Governing Law and Dispute Resolution

These Terms shall be governed by applicable laws of the jurisdiction in which the Platform operator is established, unless otherwise required by mandatory applicable law.

Users agree to attempt to resolve disputes amicably before initiating formal proceedings.
